Domain Recovery (case study)
A company has registered a domain .es identical to my trademark and keeps a website with links to my competitors and to adult content websites. The website says that the domain is for sale. I have sent an email to ask for the price and the “owner” tells me that sells the domain for 5.000€.
To register a domain in bad faith is also known as cybersquatting. It entails the duty to give back the domain to its proper owner.
If the “new owner” holds a previous right (name, trademark, business name, etc.) (+info), we will make a formal complain before a provider certified by the public business entity nic.es for the resolution of extrajudicial conflicts and will ask for the domain surrender. (+info)
At the same time, if you consider that the domain user has damaged your image or your reputation, we will claim for damages before the ordinary jurisdiction. (+info)
